Shoplifting Charges Attorney in PA
Being accused of shoplifting or retail theft can feel overwhelming. Whether the incident involved a misunderstanding at a store in York County or a mistake you regret, the consequences under Pennsylvania law are real. MPL Law works with clients facing these charges by starting with your side of the story. We listen first, then provide clear guidance about your options and what you can realistically expect moving forward.
What Are the Shoplifting Laws in PA?
Pennsylvania’s shoplifting statute, 18 Pa.C.S. § 3929, defines retail theft as taking merchandise without paying for it. The statute also covers related acts like price tag switching, under-ringing at point of sale and turning off security devices or inventory control tags. These actions qualify as retail theft when done intentionally to prevent the retailer from recovering the item’s value.
The penalties under Pennsylvania shoplifting laws depend on the merchandise’s value, as well as your prior record with similar offenses. A first offense covering merchandise under $150 is a summary offense. However, if you’re charged a second time for merchandise under $150, it becomes a second-degree misdemeanor. When the value reaches $150 or more on a first or second offense, the charge is elevated to a first-degree misdemeanor.
A third or later offense will become a third-degree felony, no matter how much the item is worth. The charge also rises to a third-degree felony if the amount surpasses $1,000 or if the merchandise is a motor vehicle or a firearm. These PA shoplifting laws make it clear that repeat offenses carry serious consequences, as do general theft charges in other contexts.
What to Do If You’re Facing Shoplifting Charges
Remain calm, avoid discussing allegations or signing store documents before consulting counsel, and avoid physically resisting detention. Loss-prevention and store-security employees are private actors, so constitutional interrogation protections generally do not apply to them, although statements made to them may later be used as evidence.
First-time offenders may qualify for Accelerated Rehabilitative Disposition (ARD). An ARD allows you to fulfill probationary requirements such as restitution, community service or classes in exchange for avoiding a permanent conviction. When you complete the program successfully, your charges can be dismissed without conviction, and you may be eligible for expungement of your record.
Contacting a defense attorney early can help determine your eligibility for ARD and preserve your options.
