Township Ownership of Cemeteries

Act 99 of 2024, effective on December 15, 2024, removed the requirement that Township-owned cemeteries retain a licensed real estate agent to sell burial plots. Townships now have the same requirements as churches, religious organizations and fraternal organizations when it comes to owning and operating cemeteries.  Ownership of cemeteries, and even development in and around cemeteries, can be complicated and impacted by various laws that are not always clear or straightforward.  Experienced legal counsel in real estate and municipal law can be important to navigate this area.
