  • First-degree felonies: First degree felonies carry a maximum penalty of a $25,000 fine and up to 20 years in prison. First degree felonies include voluntary manslaughter, kidnapping, rape and aggravated assault against a police officer.
  • Second-degree felonies: Second-degree felonies are considered less serious than first degree, and they carry a maximum penalty of 10 years in prison and $25,000 in fines. Examples of second-degree felony charges include sexual assault and burglary that takes place when no one else is in the building.
  • Third-degree felonies: Third-degree felonies include offenses such as making terroristic threats, bribery and possession of child pornography. A conviction for a third-degree felony leads to a penalty of no more than seven years in prison and $15,000 in fines.
  • Non-categorized felonies: In Pennsylvania, first, second and third-degree murder is placed in a different category than other felonies. This means the offenses can have higher maximum penalties, including the death penalty in the case of first degree murder.
