Time to Rebalance the Scales – Chevron Decision Reversed
A few weeks back, the Supreme Court issued its ruling that overturned the Chevron decision. By way of background, the Chevron case was a decision back in 1984 where the Court set forth the legal test used when U.S. federal courts must defer to a government agency’s interpretation of an ambiguous law or statute. With this latest decision, Judges can exercise their own independent judgment in interpreting Federal statutes that are silent on key issues or matters.
Essentially, the power that had been built up in the Executive Branch through its regulatory agencies was now being shifted back to the Judicial Branch. However, the real power to specify how laws are implemented still sits with the Legislative Branch. At the end of the day, this decision rebalances the power amongst the three branches of government. How much balance goes to each will be determined over time.
